GO OCEAN LOGISTICS
Terms & Conditions of Service
Effective Date: January 1, 2024 | Last Updated: May 31, 2026
1. Definitions
In these Terms, the following words have the meanings set out below:
- “Cargo” means any vehicle, equipment, or goods tendered by the Customer for transportation, forwarding, or related services.
- “Carrier” means any ocean carrier, steamship line, motor carrier, trucking company, rail carrier, air carrier, or other transportation provider engaged to perform any part of the carriage.
- “Services” means the freight forwarding, booking, documentation, and related logistics services described in Section 3.
- “RoRo” means roll-on/roll-off ocean transportation, in which operable, self-propelled vehicles are driven onto and off the vessel.
- “Bill of Lading” means the transport document issued by a Carrier evidencing receipt of the Cargo and the contract of carriage between the Customer (or shipper of record) and that Carrier.
- “Quotation” means a written price estimate provided by Go Ocean Logistics for proposed Services.
2. Our Role as Freight Forwarder
Go Ocean Logistics acts primarily as a freight forwarder, booking agent, and intermediary arranging transportation services on the Customer’s behalf. Except where we expressly issue our own transport document and identify ourselves as the contracting carrier in writing, we do not act as a common carrier and do not ourselves perform the physical ocean or inland transportation of the Cargo.
We arrange for carriage to be performed by independent third-party Carriers (including ocean lines and motor carriers) selected in good faith. The Customer acknowledges that those Carriers operate under their own terms, tariffs, and bills of lading, and that those documents govern the actual movement of the Cargo. We are not responsible for the acts, omissions, delays, or default of any independent Carrier, terminal, port authority, or government agency.
3. Scope of Services
Subject to these Terms and the specific scope set out in the applicable Quotation or booking, our Services may include some or all of the following:
- Arranging ocean transportation, including roll-on/roll-off (RoRo) and containerized shipment of vehicles and equipment;
- Booking space with ocean Carriers such as those we work with from time to time;
- Arranging domestic ground transportation (trucking) to and from ports;
- Preparing or facilitating export documentation, including filing of Electronic Export Information (EEI) through the Automated Export System (AES);
- Coordinating cargo receipt, terminal delivery, and vessel cut-off requirements; and
- Providing general guidance on documentation and the shipping process.
Charges included in a standard Quotation. Unless the Quotation states otherwise, the price we quote includes:
- Ocean freight for the vehicle from the origin port to the destination port;
- Ground trucking from the shipper’s indicated location to the nearest departure port;
- U.S. Customs export clearance documentation, including the export declaration (AES) filing;
- Complimentary marine insurance on the first $10,000 of declared vehicle value (see Section 14); and
- Courtesy mailing of original documents (see Section 9).
Charges not included. Unless expressly stated in writing in the Quotation, our price does not include the following, which remain the Customer’s responsibility:
- Port escort fees for self-delivery and any related port charges;
- Destination fees and clearing charges at the port of discharge;
- Import duties or taxes, destination terminal handling, storage, and demurrage; and
- Marine insurance on any declared value above $10,000 (available at additional cost — see Section 14).
Service notes.
- Ground trucking: we request a five (5) day window from the date the Customer indicates the vehicle will be available, so that we can schedule a trucker and begin transportation.
- Self-delivery: if the Customer delivers the vehicle to the port directly, Go Ocean Logistics will provide detailed delivery instructions. U.S. terminals typically charge $50.00–$150.00 for a port escort service, payable directly to the port at the time of delivery.
- U.S. Customs export validation: this covers Go Ocean Logistics’ filing of the export declaration that notifies U.S. Customs the vehicle will be exported.
4. Quotations and Pricing
- Quotations are estimates based on the information supplied by the Customer and on rates, surcharges, and conditions in effect at the time of the Quotation. Quotations are valid for fifteen (15) calendar days unless otherwise stated, and are subject to acceptance and to space being available.
- Ocean freight rates and accessorial charges are governed by the applicable Carrier tariff and may change based on the date the Cargo is actually received. The rate in effect on the cargo receipt date will apply. Surcharges such as bunker/fuel adjustments (BAF), wharfage, terminal handling (THC), and documentation fees may apply as set out in the Quotation or the Carrier tariff.
- Used, oversized, or non-standard vehicles and equipment may be re-measured upon arrival at the port of loading. Final dimensions and weight determined at the port may affect the price and the conditions of acceptance.
- All amounts are quoted and payable in U.S. dollars unless otherwise stated in writing.
5. Payment Terms
- Payment is made after the online reservation is completed. If you wish to arrange payment after the vehicle is dropped at the port, please contact us.
- Where deferred payment is arranged with us, payment is due within forty-eight (48) hours after the sailing is confirmed and the Bill of Lading is issued by the ocean carrier.
- The Customer is responsible for all charges incurred in connection with the shipment, including charges that arise or increase after booking due to re-measurement, schedule changes, storage, demurrage, detention, or government action. Such charges will be billed to the Customer at cost.
- All charges are earned and non-refundable once the corresponding service has been performed, except as expressly provided in Section 12 (Cancellation and Refunds). Charges are due whether or not the Cargo is lost, damaged, or delayed.
- The Customer may not withhold or set off any amount owed to us on account of any claim or dispute. We may retain a lien on the Cargo and on any documents relating to it for all sums due to us.
6. Customer Obligations and Warranties
The Customer represents, warrants, and agrees that:
- All information provided to us — including the description, make, model, year, identification number (VIN), dimensions, weight, value, condition, and ownership of the Cargo, and the names and addresses of all parties — is complete, accurate, and truthful;
- The Customer is the lawful owner of the Cargo or is duly authorized by the owner to arrange its shipment;
- The Cargo and its export are lawful and do not violate any applicable law, regulation, or sanctions program;
- The Customer will promptly review all booking confirmations, documents, and invoices and notify us immediately of any error or discrepancy; and
- The Customer will provide all required documentation and authorizations in sufficient time to meet documentation and terminal cut-off deadlines.
7. Vehicle Eligibility and Condition
- Vehicles tendered for RoRo shipment must be in safe, operable condition, able to start, drive, steer, and brake under their own power, with no significant fluid leaks and with structural integrity sufficient for safe loading and lashing. Non-operating or inoperable vehicles may require containerized or alternative handling at additional cost and are subject to Carrier acceptance.
- The fuel tank should contain no more than the minimum required for loading and unloading (generally no more than one-quarter tank), and the battery must be charged and securely fastened.
- The Customer must declare any modification, hazardous material, or condition that may affect handling, safety, or acceptance. The Carrier and the loading terminal retain the right to refuse any Cargo that does not meet their acceptance guidelines.
- Go Ocean Logistics and the Carrier are not responsible for pre-existing damage, mechanical condition, alarm systems, or aftermarket equipment.
8. Personal Effects and Goods Inside Vehicles
For RoRo shipments, no personal effects, household goods, or other loose items may be left or packed inside the vehicle unless expressly permitted in writing for a containerized shipment. The Customer is solely responsible for removing all personal property before tendering the vehicle. Go Ocean Logistics and the Carrier accept no liability for any items left inside the vehicle, and the Customer indemnifies us against any claim, fine, or penalty arising from undeclared contents.
9. Documentation and Title Requirements
- The Customer must provide the original vehicle title (or, where applicable, a certified or notarized copy or an original DMV title record acceptable to U.S. Customs and the port authority) and any other documents required to export the vehicle, within the deadlines we specify.
- If a lien exists on the vehicle (for example, an active loan or lease), the Customer must obtain and provide an original lienholder authorization letter, with a wet signature, permitting export. Some jurisdictions may require a notarized bill of sale or proof that the vehicle is paid in full.
- U.S. Customs and Border Protection generally requires that the vehicle and its title documentation be presented at the port of export a minimum number of days before vessel loading. Failure to meet documentation cut-off dates may result in the Cargo being rolled to a later vessel, with resulting storage and re-handling charges payable by the Customer.
- After we receive the Customer’s completed shipping order, we will request a copy (photo) of the vehicle title (front and back) and any required supporting documents, which may include a bill of sale, government-issued ID or passport, and a Tax ID (EIN) where applicable.
- Go Ocean Logistics provides a courtesy mailing service at no additional cost for original documents during the shipping process. Once the shipment is completed, the original title will be returned to the address the Customer provides, and all mailing costs are covered by Go Ocean Logistics.
10. Export Compliance
11. Sailing Schedules and Transit Times
All sailing dates, departure times, transit times, and arrival dates are estimates only and are not guaranteed. Vessel schedules are controlled by the Carriers and are subject to change, delay, omission, rolling, transshipment, port congestion, weather, customs inspection, and other circumstances beyond our control. For consolidated or shared-container shipments where applicable, the Cargo may not sail until the container is full, and dates shown are estimates updated only after actual sailing.
Go Ocean Logistics is not liable for any loss, cost, or damage — including consequential, special, or indirect loss — arising from any delay, schedule change, or failure of a vessel to sail or arrive as estimated.
12. Cancellation and Refunds
- Go Ocean Logistics does not charge a cancellation fee for its own services.
- Refunds can only be issued for services that have not yet started.
- The Customer (shipper) is responsible for any cancellation fees charged by trucking companies, ocean carriers, terminals, warehouses, or other third-party vendors involved in the shipping process. These fees vary by provider and must be paid by the Customer.
- If a shipment is cancelled before a Carrier or service provider begins its portion, any charges already incurred — including booking, filing, dispatch, and storage — must be paid before a refund can be issued.
- Once a shipment enters the export process — for example, when the Cargo has been delivered to the terminal, accepted by the Carrier, entered in the container yard, or loaded aboard a vessel — refunds are no longer possible.
13. Storage, Demurrage, and Detention
14. Marine Cargo Insurance
- Each shipment includes complimentary marine insurance covering the first $10,000 of declared vehicle value at no additional cost — a benefit of approximately $145.
- Any declared value above $10,000 may be insured at a rate of 1.45% of the additional declared value. For example, for a vehicle valued at $15,000, the first $10,000 is covered at no cost and the remaining $5,000 may be insured for $72.50.
- Coverage, eligibility, deductibles, premiums, and exclusions are governed by the insurer’s policy terms. The Customer is responsible for declaring the correct vehicle value and for confirming that any coverage matches the Customer’s needs and the vehicle’s eligibility. We recommend that the Customer insure the full value of the vehicle, as a Carrier’s standard liability under its bill of lading is limited and may be far less than the value of the Cargo.
- Procuring insurance does not make Go Ocean Logistics an insurer. Any claim must be made directly against the insurer in accordance with the policy.
15. Limitation of Liability
To the maximum extent permitted by law, Go Ocean Logistics’ liability arising out of or in connection with the Services is limited as follows:
- We are liable only for loss or damage caused by our own proven negligence in the performance of our forwarding Services, and not for the acts, omissions, default, delay, or insolvency of any Carrier, terminal, warehouse, customs broker, or other third party.
- Our total aggregate liability for any claim shall not exceed the lesser of (a) the amount of fees we actually earned for the specific shipment giving rise to the claim, or (b) any higher limit required by applicable law. The Customer may request a higher limit in writing in advance, subject to a written agreement and an additional charge.
- In no event are we liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profit, loss of use, loss of market, or diminution in value, however arising.
- Any claim against us is waived unless the Customer gives written notice within nine (9) months of delivery (or, where the Cargo is lost, within nine (9) months of the date it should have been delivered) and brings suit within two (2) years of the same date, or within such other period as required by applicable law or the governing Carrier bill of lading.
16. Indemnification
The Customer agrees to defend, indemnify, and hold harmless Go Ocean Logistics, its owners, officers, employees, and agents from and against any and all claims, fines, penalties, duties, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: inaccurate or incomplete information provided by the Customer; the Customer’s breach of these Terms; any violation of export, customs, or sanctions laws; undeclared or prohibited contents; or any third-party claim relating to the Cargo.
